Concept Car Credit Limited, a used-car dealer from the Greater Manchester area has been fined £40,000 by the Information Commissioners Office (ICO) for sending more than 300,000 marketing spam text messages. They reportedly received the data from other organisations but failed in their duty to check that they were only contacting people that had consented to receive the marketing communication.

Further court action may follow if the company does not abide by an enforcement notice issued by the ICO, to stop sending unlawful texts in future.

If you have been receiving unwanted marketing communications you can report nuisance calls, texts and emails at ico.org.uk. Spam texts can also be reported by forwarding them to 7726. 

As you a business owner you should be aware of the general rules around direct marketing. The ICO has published detailed guidance for firms carrying out direct marketing by phone, text, email, post or fax.
